Carson City arrests: Man booked for possession, intent to sell after nearly a pound of pot found

The Carson City Sheriff’s Office Special Enforcement Team arrested a 24-year-old man on felony drug charges after a traffic stop for driving with a broken headlight, a Carson City sheriff’s sergeant said.

Cody James Abernathy of Fallon was arrested July 6, 9:36 p.m. in the area of Hot Springs Road and Pine Lane. He faces felony charges of possession of more than 1 ounce of marijuana, possession of marijuana with intent to sell, and misdemeanor DUI drugs and criminal contempt.

According to the arrest report, the sergeant observed the vehicle driving with one high beam headlight and the other inactive. He attempted to stop the vehicle with flashing lights and a siren, which the driver continued and did not stop.

The vehicle continued, turning onto Pine Street with the SET sergeant observing the man driving the entire length of Pine Street without pulling over.

The driver eventually pulled over and told the officer the vehicle did not belong to him. He provided insurance and registration. He did not consent to an exterior sniff of the vehicle by a canine saying the car was not his. On his person, deputies located an empty capped needle in his front left pocket and a “tieoff” rope around his wrist and a piece of foil on the front seat. These items are commonly used for injecting narcotics.

With probable cause, a K9 sniff was done on the exterior of the vehicle and the dog alerted positive, the SET report states.

Deputies located 5 packaged bags of marijuana with a digital scale, glass pipe with marijuana residue inside a bag on the front seat. Four of the plastic bags weighed 16 grams and 1 baggie, 10 grams. Two needles were also located with a bandana tie-off. In the back seat of the vehicle, deputies located a large bag of marijuana that contained 12.5 ounces, the SET report states.

The man had red, blood shot eyes and his motions were slow and agitated. He was asked when the last time he smoked marijuana and the man said he did not want to answer the question. He refused a field sobriety test. Due to his failure to yield for a traffic stop, his eyes red and bloodshot, a green tint in his mouth, and easy access to the marijuana, pipe and needles, officers suspected the man was under the influence. He was arrested and agreed to a blood draw at jail, the SET report states.

The man was placed on a criminal contempt hold with a $500 cash only bail. He faces charges of possession of more than 1 ounce of marijuana (total weight of all packages is 15.11 ounces), possession of marijuana with intent to sell/packages for sale (four bags of equal weight with a scale, and DUI drugs. Bail: $9,137.
