Custody dispute lands Carson City man in jail for allegedly ramming vehicle with children inside

A 31-year-old Carson City man was arrested Saturday for felony suspicion of battery with a deadly weapon, gross misdemeanor child endangerment, and two misdemeanors, a sheriff’s deputy said.

Robert Marshall Gallina, was taken into custody at 5:12 p.m. in the 300 block of East Winnie Lane.

According to the arrest report, deputies were sent to the area in reference to a child custody dispute. Deputies made contact with the suspect and a woman who had an extended protective order against the man. She said the man followed her twice, once in the morning as she was taking her children to a babysitter, where he followed her, pulled up alongside of her and asked where she was taking the children, the arrest report states.

After she dropped off the children at the sitter's he then followed her and confronted her at a convenience store about where the children were. She told the deputy the man then asked for the babysitter’s phone number. She gave it to him and left for work. At around 4 p.m. she returned to the babysitter to pick up the children, according to the arrest report.

The woman said the man texted her saying he was going to pick up the children. It was not his weekend per court order to have the children, according to the arrest report. She picked the children up and continued toward her residence. She told officers that as she was stopped at a light on Hot Springs to turn left on Roop, she saw him driving his truck south on Roop. She said he started to turn south and then intentionally ran the left front quarter panel of his truck in the left front quarter panel of her car, the arrest report states.

She said she then turned south onto Roop where he began following her. She drove to a Winnie Lane bar where she knew her father was there so that he could assist her. Once at the location, the suspect and woman argued over child custody until deputies arrived.

The man told deputies he went to pick up the children. He said the woman flipped him off and said she swerved her car toward his and they collided. He then followed her to the bar on Winnie Lane. A deputy could smell a moderate odor of alcohol on the man’s breath. He said he drank at least a beer and shot earlier, the arrest report states.

He performed a series of standardized field sobriety tests. He attempted to provide a preliminary breath sample but provided inadequate samples three times, according to the arrest report. The man was taken into custody for being in violation of the extended protection order, and for intentionally having rammed his vehicle into the woman while his son and the woman’s other child were in the vehicle, the arrest report states.

A computer check showed Gallina is currently under supervision of Department of Alternative Sentencing. DAS added a violation of suspended sentence charge. He was taken into custody and booked into Carson City Jail. Total bail amount listed: $36,911.

In other arrests:
— A 24-year-old Carson City woman was arrested Sunday for misdemeanor suspicion of domestic battery. According to the arrest report, deputies were called to the 700 block of Hot Springs Road for a report of domestic battery. When they arrived they met with the reporting party (RP) who stated she and her husband were drinking and got into an argument. She responded by allegedly going to the man’s computer and attempted to rip cords from the computer. She said the man pinned her to the ground. She stated she then punched him in the face and called 911.

The man stated he and his wife were drinking alcohol and arguing. He stated he left the apartment to get the woman another beer in hopes she would calm down. When he returned he said the woman continued to argue with him in an aggressive manner, grabbed a drink out of his hand and threw the liquid in his face.

The man told deputies he disengaged, and went to the computer and put on his headphones. He said she then went toward the computer and was going to “yank” the computer out of the wall and throw it to the ground. He stated she was standing by the computer and the woman began pushing him away to get to the computer.

He stated he grabbed his wife and pinned her to the ground, putting her arms behind her back. He stated she was able to break free because she is stronger than he is. He said the woman then punched him on the right side of his face. He stated he was able to get control and pin her hands behind her back again and told her to stop being violent. He stated when the woman stopped he let her go and that’s when she went into the bedroom and called 911, the arrest report states.

The man had injuries to the right side of his face that were consistent with being punched. The woman had bruising on her right wrist and upper left shoulder consistent with being held down. A deputy asked the man if he wanted to fill out a statement form. The man replied: “I do not want to provide evidence about my wife.” During the investigation it was determined the woman was the primary aggressor and she was arrested. Bail: $3,137.

— A 39-year-old Carson City man was arrested Sunday, 9:34 p.m. in the 1800 block of North Carson Street for misdemeanor suspicion of petit larceny warrant. Bail: $250.

— A 32-year-old Carson City man was arrested Sunday, 11:35 a.m. in the 4900 block of August Drive for a misdemeanor contempt of court warrant. Bail: $315.

— A 23-year-old Carson City man was arrested Sunday, 10:50 a.m. in the 500 block of East William Street for a misdemeanor warrant, failure to appear, issued Jan. 15, 2019. Bail: $250.

— A 37-year-old transient was arrested Saturday, 1:20 p.m. in the 1400 block of South Carson Street for a misdemeanor failure to appear warrant issued Jan. 8, 2019 out of Carson City Justice Court. Bail: $100.

— A 38-year-old transient was arrested Sunday, 3:28 a.m. in the area of Curry and Musser streets for a misdemeanor violation of suspended sentence warrant for failure to report for color code testing, failure to report for monthly probation reporting, issued Dec. 6, 2018 out of Carson City Justice Court. Bail: $3,000.

— A 56-year-old transient woman, Laura E. Wedge, was arrested Saturday, 7:01 p.m. in the 500 block of North Carson Street for suspicion of possession of a controlled substance, a felony and a misdemeanor contempt of court warrant. According to the arrest report, the woman had a warrant for her arrest and was taken into custody. During a search she said she had a methamphetamine pipe in her pocket. The pipe was tested and returned positive for the presence of methamphetamine. Bail: $3,000.

— A 33-year-old transient, Tomas Andrew Parker, was arrested Saturday, 11:59 p.m. in the area of William and North Carson streets for a felony failure to appear warrant from Arizona alleging theft of means of transportation, criminal impersonation and false reporting to law enforcement.

According to the arrest report, a deputy observed a male subject standing on the sidewalk next to a bank and was swinging, what appeared to be a wooden stick, toward the bank. The deputy made contact with the man, who verbally identified himself. He was asked why he was swinging a wood stick at the bank. The man replied he wanted to break the window so he could go to jail. The deputy asked why he wanted to go to jail and the man did not answer. There were no damages to the bank window or the building. The deputy performed a records check on the identification the man provided, which returned with the confirmed warrant out of Arizona. Bail: $10,000.

— A 63-year-old Carson City man was was arrested Saturday, 9:01 p.m. at Fuji Park and Old Clear Creek Road for misdemeanor suspicion of disorderly conduct. According to the arrest report the man was highly intoxicated and refused to leave. When officers arrived the man was verbally upset and aggressive, raising his voice and using profanities.

The officer asked the man what the issue was and how he could help. The man continued to become verbally aggressive with the deputy in the presence of officers and approximately 15 other subjects attending a charity event.

Deputies made multiple attempts to have the man leave with his wife and stepson. He refused to leave and requested to be arrested. As he was being escorted to his wife’s car in an attempt to place him in the back seat, the man took an aggressive stance and lunged toward his wife with his right arm. He did not make contact. Due to observing his aggressive behavior and unwillingness to comply he was arrested for disorderly conduct. Bail: $242.
