Carson City deputies arrest man for suspicion of 3rd DUI

A man was arrested early Wednesday morning for suspicion of felony third DUI and other charges, a Carson City sheriff's deputy said.

Brian Matthew Tucker of Reno was taken into custody at 2:52 a.m. in the 1300 block of North Carson Street. He also faces charges of failure to obey a traffic control device, resisting a public officer and driving with a suspended driver's license.

According to the arrest report, a deputy observed a red sedan fail to make a complete stop at a stop sign at the intersection of North Nevada Street and Fleischmann Way. The deputy conducted a registration check, which came back that the owner had a suspended driver's license. The sedan turned into a motel parking lot, where the deputy made the traffic stop.

The driver quickly exited the sedan and stumbled. The deputy informed Tucker to get back into his vehicle. The man asked why. The deputy could smell a strong odor of alcohol coming from the man, who also had slurred speech. The man was ordered to get back into the vehicle. He began walking backwards asking why he needed to get back into the vehicle, the arrest report states.

The deputy ordered the man to put his hands behind his back. The man pushed the officer away. Another deputy assisted and the man was taken to the ground where handcuffs were put on him. The deputy asked him how much he had to drink, which he stated not much, the arrest report states.

The deputy read the man the evidentiary test warning. Tucker said he was not willing to do testing without an attorney. At jail he was asked if he was willing to perform standard field sobriety tests, which he stated no, the arrest report states.

The officer applied for, and was granted, a search warrant allowing for a blood draw. Bail: $21,161.

A deputy located the subject as described walking in the parking lot near a restaurant. The deputy recognized the man from recent contacts. He was walking in an unsteady manner near the vehicle entrance of the shopping center parking lot. It appeared to the deputy that the man was simulating, with his hands, pointing a gun at passing vehicles, the report states.

The officer identified himself and the man did not reply and began to walk away. The officer took both hands of the man said "sheriff's office." The man tightened his arms. He was taken to the ground and handcuffed.

The deputy could smell a strong odor of alcohol coming from the man. The deputy administered a preliminary breath test that indicated a .282 BAC. He was arrested for disorderly conduct, taken to the hospital for medical clearance, and then to jail. Bail: $242.

— A 29-year-old Gardnerville man was arrested Tuesday for gross misdemeanor battery of a protected person. According to the arrest report, deputies were dispatched to a clinic in the 1000 block of North Minnesota Street where a patient had punched a nurse and was actively fighting with a security guard.

On arrival, officers made contact with the security guard and suspect. Security had the suspect's hands behind his back. A deputy spoke with the man who appeared to be having a mental episode at the clinic. Deputies spoke with a nurse who advised she was punched in her chest area.

The nurse was asked if she wished to press charges. She advised she did. Medical staff advised a second nurse was punched in the right hand as well as the security guard, who had been battered. Neither wished to press charges.
