Carson City Sheriff's arrest log: Man violates TPO, then resists arrest

A 30 year-old Carson City man was arrested Saturday morning at 8:50 a.m. in the 2000 block of West College Parkway for misdemeanor violation of a temporary protection order (TPO) and resisting an officer, a Carson City Sheriff's deputy reported.

According to the arrest report, a Sheriff's deputy was dispatched to a residence on Bryan Circle for a reported TPO violation. The TPO was confirmed active by dispatch and served Jan. 30 by a deputy.

The TPO holder said the restraining order was granted because her ex-spouse had become obsessed with her daughter, who is not his.

According to the holder, her ex-husband had made previous comments about wanting to be with and have sex with her daughter, the report said.

As such, the TPO holder sought out the restraining order against him.

She reported to deputies that on the day her ex was served, he reportedly showed up at the daughter's former workplace and began yelling for her from outside of the business.

She further reported that the suspect had arrived at her daughter's school and began asking other students to have her come out to see him, the report said.

Then at about 3 a.m. Saturday morning, the TPO holder stated that her telephone rang from an unknown out-of-state number, and the suspect was on the other end of the line.

The suspect reportedly told the holder that he wanted to live with her daughter and wanted the mother to get out of the way, the TPO holder reported.

On the phone, the suspect admitted to wanting the daughter sexually and would wait until she became a legal adult, the holder stated in the report.

The TPO holder expressed to deputies that she and her daughter are scared, constantly keeping an eye out for the suspect.

During the conversation with deputies, the holder's phone received a text from the same number that called her earlier in the morning, the report said.

The text read, "Come over please, I want to talk."

After receiving a written statement from the TPO holder, deputies then made their way to the suspect's residence off W. College Pkwy.

The male who answered from inside the residence matched the booking photo they had on file for the suspect. He allowed officers to talk with him inside, the report said, appearing very nervous on initial contact.

The suspect immediately denied talking with the TPO holder or being in love with her daughter when queried by deputies.

However, he later admitted to having talked with the holder 2-3 days earlier about their children together. Deputies informed the suspect that he was not allowed to contact the TPO holder, his ex-wife.

The suspect claimed that he didn't think the TPO was any good, and handed the ripped up paperwork over to officers, the report said.

Deputies informed the suspect that the TPO was, in fact, valid and he was not allowed to have any contact with its holder.

The suspect opened his phone when requested by deputies and showed them his call log. The only call on it belonged to an out-of-state number appearing similar the one that had called the TPO holder early in the morning, the report said.

A second cell phone was found in plain view of officers inside the apartment, and the number belonging to that one matched the number that had called and texted the TPO holder, the report said.

The suspect became uncooperative and was detained in handcuffs. But he refused to put on his shoes and began yelling, the report said.

He also attempted to pull away from deputies and not walk with them. One deputies placed the suspect's bound hands in a gooseneck and started to walk him backward.

But the suspect tried to free his hands from the cuffs, the report said, and was then taken to the ground for officer safety.

He was held down until the cuffs were adjusted around the wrists. Then the suspect was placed in the patrol unit, where he was further uncooperative and not allowing himself to be seat-belted by the offficer.

He began to bang his head on the cage and refused any commands given by deputies.

In spite of the suspect's behavior, he was successfully taken into custody and transported to the Carson City Jail for booking.

Bail: $1,549.

In other arrests:

— A 52 year-old Carson City man was arrested Sunday night at 7:03 p.m. in the 1300 block of Ashby Court for misdemeanor battery, a Carson City Sheriff's deputy reported.

Sheriff's deputies were dispatched to a residence on report of physical domestic battery, according to the arrest report, and a male subject was reported to be highly intoxicated.

Deputies made contact with the reporting person (RP), who was inside her vehicle with her child.

The RP, who was also the victim, reported that the male subject had been drinking all day and had tried to leave in a vehicle.

The victim said she tried to get the keys from the suspect, who then became physically aggressive, reportedly kicking her and leaving a red mark on her right knee.

The RP wished to press charges and signed a citizen's arrest form, the report said.

Contact was then made in the residence with the suspect, who reported to officers that when the RP tried to stop him from using a vehicle, he pushed her. He denied kicking the RP, the report said.

When asked how much he had to drink, the suspect stated a pint and a half. He provided a voluntary preliminary breath test (PBT) that yielded breath-alcohol content (BAC) of .176 percent, the report said.

Because of the marks on the RP/victim, the suspect was determined to be the primary aggressor was detained in handcuffs, the report said.

He was placed in custody and transported to the Carson City Jail for booking.

Bail: $1,137.

— A 41 year-old Carson City man was arrested Sunday morning at 6:39 a.m. at a business in the 400 block of North Carson Street on misdemeanor disorderly conduct and trespassing, a Carson City Sheriff's deputy reported.

According to the arrest report, Sheriff's deputies responded to a business on report of an unwanted subject. The RP stated a male found sleeping inside of the business had already been trespassed from the property earlier.

The suspect had reportedly left and then came back at around 6:30 a.m. Sunday. When the RP told the suspect to leave, the latter refused.

The RP requested that the suspect be arrested for trespassing, completing a citizens arrest form before pointing out the suspect to deputies.

The male suspect was located sleeping in a seated position. Deputies awakened him and obtained his identifying information.

He was subsequently handcuffed, placed in custody and transported to the Carson City Jail for booking.

Bail: $484.

— A 41 year-old Carson City man was arrested Sunday at 5:04 a.m. in the 1300 block of North Carson Street on charges of felony drug possession, misdemeanor obstruction and a contempt of court warrant, a Carson City Sheriff's deputy reported.

David Alvarez-Garcia was taken into custody after being stopped by a Sheriff's deputy, who had observed him walking south on Carson Street before quickly disappearing into a full motel parking lot, the arrest report said.

He as located shortly thereafter and contacted by the deputy, who asked him if he resided at the motel. The suspect said he did not currently live there and declined to give his name when asked by the deputy.

The suspect then began to walk away and the officer advised him that he needed to identify himself before leaving, the report said.

He tried to walk away a second time before finally giving a false first name and incoherently mumbled a surname to the officer.

The suspect continued to be uncooperative with the deputy despite multiple orders to identify himself, so he was arrested for obstruction and delaying a peace officer, the report said.

A weapons search incident to arrest recovered a clear, crystalline substance recognized as methamphetamine inside of a jacket pocket, the report said.

Upon being transported to the Carson City Jail, the suspect finally provided correct identifying information, which was then cross-checked for wants and warrants.

The records check confirmed an outstanding misdemeanor bench warrant for contempt of court issued by the Carson City Justice Court.

He was booked into the jail without incident. Bail: $2,990.

— A 43 year-old Gardnerville woman was arrested Saturday night at 7:45 p.m. in the area of Mountain Street and Fleischmann for misdemeanor hit-and-run and first-offense driving under the influence (DUI) of alcohol, a Carson City Sheriff's deputy reported.

According to the arrest report, a Sheriff's deputy was dispatched to the area of Fleischmann and Mountain on report of a hit-and-run incident.

The victim of the hit-and-run crash described the vehicle leaving the scene as a blue Ford sedan, which Carson City Dispatch later informed the deputy that security at a downtown gaming business observed the suspect vehicle entering the parking lot with its front bumper hanging off.

The deputy responded to the location and made contact with the driver of the suspect vehicle. She admitted to driving, the report said, displaying red, watery eyes and exhibiting slurred speech.

The suspect's breath also smelled of alcohol.

When asked how much she had drank, the suspect told the deputy that she consumed one shot.

The suspect consented to both standard field sobriety tests (SFSTs), which showed 14 signs of impairment, and a preliminary breath test (PBT), which yielded breath-alcohol content (BAC) of .126 percent.

She was handcuffed and placed in custody at that point, and transported to the Carson City Jail for booking.

Bail: $1,846.
