Carson City arrests: intoxicated man jailed after gun discharges into downstairs apartment
A 46-year-old Carson City man was arrested Monday in the 700 block of Hot Springs Road for suspicion of being in possession of a firearm while intoxicated after a bullet from a gun was discharged, by accident, into a neighbor's apartment, a Carson City sheriff's deputy report states.
Deputies were called to the area just after 7 p.m. regarding a shots fired call. On arrival officers met with a woman and her daughter who advised they were watching TV at the time when they heard a loud bang. The woman looked up at her ceiling and noticed a hole coming from her upstairs neighbor's apartment.
The man came down the stairs and apologized, saying he was cleaning his gun when he accidentally fired a round. At around that time a neighbor had advised to call 911, the report states.
Deputies spoke with the suspect, who was read his Miranda warning and agreed to speak. He said he was in his living room cleaning his gun. He said he thought the gun was empty and said he accidentally shot a round, the report states. The man told deputies he went downstairs to check on his neighbor.
He advised he had gotten home from hunting and started drinking and cleaning his gun. He stated he was drinking vodka and a couple of beers. He provided a preliminary breath test of .297 and completed a voluntary written statement.
Deputies photographed both apartments and where the bullet hole was located. Deputies were unable to locate the bullet projectile inside the neighbor's apartment. The officer took possession of a Glock 40 the man said he had been cleaning and also took possession of the magazine belonging to the gun, which was full with ammunition and the spent casing that was fired, the arrest report states.
The woman completed a written statement and signed a citizen's arrest form. Deputies spoke with a Carson City deputy district attorney who confirmed the appropriate charge would be possession of a firearm while intoxicated. The man was arrested on the misdemeanor charge. At jail he consented to evidentiary breath tests, with results of .153 and .149. Bail: $1,137.
