Carson City man arrested for trespassing, claimed ownership of vacant home
A 52-year-old Carson City man was arrested Wednesday for misdemeanor trespassing after telling a sheriff's deputy that he could claim legal ownership of a vacant home because it was vacant.
According to the arrest report, a deputy was dispatched to the 2100 block of Bunch Way in reference to a subject inside a vacant home.
Upon arrival, the reporting party (RP) stated the house had been vacant for some time and that a man came up to the RP and stated he paid taxes on the property and now he owns it. The man then began to work on the vacant house as it were his, the arrest report states.
A deputy made contact with the man inside the home who identified himself. He said he was following a law called "adverse something" which, he said, states he could move into a vacant house as long as he was actively restoring it. The man said he got into the home by walking through the side gate and finding an open back door.
There were "no trespassing" signs on both gates to access the property and a "no trespassing" sign in the front yard visible from the street, the arrest report states.
The deputy made contact with the property owner who's stated he has owned the property since 2007 and makes monthly payments on it. He stated nobody should be on the property and further added that he placed "no trespassing" signs on the property approximately six months ago due to a similar incident involving a subject living on his property without consent. The property owner stated he wanted the man arrested for trespassing. Bail: $242.
