Carson City man accused of discharging firearm inside apartment while under the influence

A 23-year-old Carson City man was arrested Saturday in the 1300 block of North Edmonds for felony suspicion of discharging a firearm into an occupied dwelling, and misdemeanor possession of a firearm while under the influence.

Booked was Diego Ramirez for the alleged offenses. According to the arrest report, dispatch was called to a residence on North Edmonds after a report of a woman who heard loud noises from the apartment above her and then later located a bullet inside her apartment as well as a hole in the ceiling.

Deputies made contact with the victim, who was with a small child at the residence. She said that at around 8:40 a.m. she heard loud noises coming from the apartment above her, heard a male curse, and then banging noises as if someone was throwing something. She later called her fiancé who came over and that's when they found a bullet on the ground and a hole in the ceiling, according to the arrest report.

Deputies observed the bullet, which had been collected from the floor and placed inside a face mask. The bullet appeared to having rifling marks on it as well as white paint transfer from the ceiling. The deputy observed a small hole in the ceiling consistent with a bullet hole, along with a small piece of drywall on the counter as well as drywall particles on the floor.

Officers then met with the suspect who was sitting outside, who had been drinking and had an alcoholic drink in his hand while talking. He told deputies that earlier someone was attempting to break into his apartment and so he fired off multiple warning shots, the report states. Located was a Taurus pistol inside a plastic bag he was carrying.

Ramirez was not clear on how many shots he fired but believed two. He was read his Miranda warning, and said he didn't understand it. The officer explained what his rights were and, later, he was willing to speak, the arrest report states.

While speaking, officers could smell an odor of alcohol coming from his person. He said no one was inside the apartment when he fired the warning shots. He later said that he knew he made a mistake and had no one to blame but himself.

He was arrested and taken to the detention center where he signed a consent for a blood draw. Bail: $21,137.

In other arrests:
A man and woman were arrested Sunday night for suspicion of assault with a deadly weapon and other offenses following an incident involving a vehicle pursuit.

Jose Luis Baro, 28, listed as a transient, was arrested at 11:27 p.m. at Highway 395 and Mica Drive for suspicion of felony assault with a deadly weapon, felony eluding and danger to persons or property, parole and probation violation, reckless driving and driving without a valid license.

Also arrested for suspicion of felony assault with a deadly weapon was Jazmyn Denise Garcia, 27, of Stockton, Calif.

According to the arrest report, deputies were dispatched at 10:47 p.m. to the 5400 block of Carson Street for a report of a fight. A few seconds later, dispatch further advised two males and a female were involved in a fight and they were reported to have knives.

Dispatch advised one male was associated to a white 4-door sedan and was reported to have a knife. The male was last seen walking toward a casino. The reporting party stated the male subject then began to smash car windows in the parking lot of the casino and that a female had taken a swing at the man, the arrest report states. No other details were available Monday on the alleged window smashing incident.

Officers arrived and located a white Chevy Impala in the parking lot. The deputy activated his red and blue emergency lights, attempting to stop the vehicle. The vehicle failed to yield, exited the casino parking lot and began to drive south on Carson Street. The officers began a pursuit of the vehicle, and notified Douglas County. The vehicle entered the Carson Valley Plaza in Douglas County.

A deputy observed the driver throw an item, which appeared to be a black belt, out the driver window. The vehicle then exited the Carson Valley Plaza and continued driving south on U.S. 395. The vehicle was traveling around 50 mph in a 55-speed zone, the report states.

The vehicle failed to come to a complete stop at the stop light at Jacks Valley Road and US 395. The light was a solid red when the vehicle drove through it. The pursuit continued, at one point reaching 90 mph in a 55 mph zone. The vehicle then slowed down and came to a stop on the side of the road before Plymouth Drive in Douglas County.

Officers conducted a high risk stop, giving the occupants commands to have all subjects in the vehicle put their hands up. The driver and passenger placed their hands up. Deputies gave commands to the driver, Baro, to exit the vehicle, in which he followed the commands. The passenger, Garcia, also followed the commands.

According to the arrest report, deputies spoke with the victim earlier who stated he had heard someone honking their horn for around 15 seconds and then stopped and then started again at the Comstock RV Park. He said he went outside to check and said that's when the driver, Baro, exited the vehicle, approached him in an aggressive manner. The victim told Baro he just wanted to sleep. The victim stated Baro had his hand behind his back and was approaching him aggressively. He said he was unsure if the man had a knife or a firearm in his hands.

The victim stated the female then exited the vehicle and approached him aggressively, swearing at him, and then displayed a knife with a blade. The victim stated the woman swung her knife at him but did not hit him, the report states.

The victim stated he went backside and asked his girlfriend to call 911. He stated the suspects then began to walk between his vehicle on the property. He stated he grabbed his own knife, showing it to the couple as they continued to get closer to him. The couple then left.

Officers interviewed the couple, who stated they went on a road trip and began to argue. Baro said he didn't want to argue while driving and so he pulled over into the entrance of Comstock RV Park. He stated that the male subject brandished a knife toward him and Garcia.

He further stated he didn't pull over during the police pursuit because he thought he was being chased by the same subject who, he said, pulled a knife on him. Both Baro and Garcia were arrested for the alleged offenses.

Suspect Baro became uncooperative during the investigation and began to mule kick the patrol vehicle door during transport. Bail for Baro: No bail hold for the parole and probation violation. Bail for the other charges: $48,829. Bail for Garcia: $20,000.

— A 26-year-old Carson City man was arrested Sunday, 8:49 a.m. for misdemeanor probation violation. As part of his probation terms he wasn't allowed to consume alcohol. The man was drinking and had a preliminary breath test of .305. Bail: $3,000.

— A 50-year-old Carson City man was arrested Saturday, 10:41 p.m. in the 3500 block of Highway 50 East for misdemeanor being an ex-felon failing to register. Bail: $242.
