A 55-year-old man was arrested Nov. 19 for suspicion of felony commercial burglary, according to a Carson City Sheriff’s Office booking report.

Daniel Alexander Kwiatkowski was taken into custody at 9:37 a.m. following an investigation. He was also booked for misdemeanor being an ex-felon failing to register.

According to the booking report, deputies were dispatched to the 2100 block of California Street for a burglary report. Deputies spoke with the reporting party who is the apartment complex property manager. They advised that in the early morning hours of Nov. 17, a snow blower was stolen from an enclosed maintenance area. The area was surrounded by a fence with padlocks at both access points.

The manager said he had surveillance from the incident and was able to identify the suspect as Kwiatkowski, who lives in the apartment complex, the report states.

Deputies reviewed video footage and observed the man entering the corridor, where the access to the locked fence was. He was seen looking at the surveillance camera and locked gate. He was wearing gloves, shorts with a jacket and a dark-colored beanie. The man then is seen leaving the camera view.

More video footage from two cameras show the man hanging out in the courtyard and speaking with another male subject. At approximately 12:37 a.m both subjects leave the camera view. On camera one, at approximately 12:40 a.m., the camera is sprayed with paint and nothing else is seen.

The manager advised that the suspect came into the office on Nov. 18 talking about a white enclosed trailer that was parked in the parking lot. The suspect told the manager the trailer belonged to him and he was trying to register it. The suspect then told the manager he was going to move the trailer into the parking lot closer to his apartment building. The manager said the trailer was no longer in the parking lot where he had originally saw it.

The manager then provided the deputy with the serial number and model number for the snow blower, which was red in color. He also stated the snow blower had a value of $1,200. The manager completed a witness statement.

A deputy then spoke with the other person seen with the suspect earlier. The officer asked what they spoke about. He said the man asked him to help him with something and walked him to a fence area, where the suspect asked if he could help him move it. He told the suspect no and then left the enclosed area.

The man was asked if he saw the suspect remove the snow blower from the fenced area. He said yes, having seen him take the snow blower into the parking lot. The officer asked if he saw what vehicle the suspect put the snow blower in. The man said he put the snow blower in his truck and described the truck as a beige Ford with two doors, the report states.

Deputies then went to the suspect’s apartment and contacted him. A deputy told the suspect he was seen on video surveillance in the area where a snow blower was stolen. The suspect said it wasn’t him. The deputy then told the man there was a witness who saw him take the snow blower from the secured area. The suspect again told the deputy it wasn’t him, the report states.

The suspect was placed under arrest for commercial burglary, was read his Miranda rights and asked if he would speak. The man said “no,” the report states. Bail; $20,000.

According to the booking report, deputies were dispatched at 3:47 p.m. to the 5800 block of South Carson Street regarding a welfare check on a subject in a vehicle. Dispatch advised the vehicle had been observed driving on the wrong side of the road. The driver was passed out and the vehicle had come to rest on the center median.

Deputies arrived on scene. Nevada Highway Patrol had obtained statements from witnesses and the driver was in the back of an ambulance.

One of the witnesses observed the vehicle driving on the wrong side of the road and observed the driver unconscious in the driver’s seat and the front passenger attempting to steer the vehicle from the front passenger seat, the report states.

The witness was able to remove the driver from the driver’s seat and observed that he was choking on vomit. He observed an aerosol can (can of air) below the driver’s feet on the front driver’s side floorboard. It was learned the driver was doing “whipits” while driving, the report states. The witness advised the driver showed signs of impairment to include red watery eyes, mumbling and nonsensical speech and confusion.

The deputy notes in the report that “whipits” is a common slang term for huffing compressed air, nitrous oxide or other aerosols. Huffing these aerosols can cause briefing tingling sensations or a brief high. It also causes blurred vision, slurred speech, impaired coordination, sweating, shivering, nausea and loss of consciousness.

The passenger advised he and the driver were huffing the aerosol cans while driving southbound on Carson Street. He said they crossed onto the wrong side of the road near Clear Creek. He said he looked over and saw the driver was unconscious and vomiting. The passenger said he reached across the center console, pulled the steering wheel to the left and drove them onto the center median, then coming to a complete stop.

The investigating deputy elected to conduct field sobriety tests on the driver. He showed signs of impairment on the tests. A search of the vehicle yielded a compressed air aerosol can on the front driver’s floorboard as well as a red rag. It should be noted that when using aerosols the can becomes very cold. A towel or rag can be used to prevent discomfort while holding onto the can, the report states.

Based on witness statements of the driver huffing the can while driving, the driver losing consciousness and vomiting on himself, the field sobriety tests, he was arrested. Bail: $1,137.
