Carson City man jailed on felony domestic battery and home invasion charges

UPDATE: Carson City sheriff's office deputies made multiple felony and misdemeanor arrests from Friday through Monday during the Memorial Day weekend holiday period. Felony arrests were for domestic battery, weapon and drug charges.

A 30-year-old Carson City man was arrested Saturday on felony charges of home invasion and domestic battery stemming from a May 16 incident on Applegate Way, according to the Carson City Sheriff's Office.

Joshua Terry Stephens is being held on $44,000 bail. According to the arrest report, officers received information that Stephens was at an Applegate Way address. They had been looking for him for several days to arrest him on suspicion of home invasion and third offense domestic battery.

A perimeter around the location was formed because Stephens is known to flee. Officers approached the home and instructed a woman to exit with her son. She complied, and gave officers permission to enter the home.

Deputies entered and detained the man as he was exiting the garage. The garage area smelled of freshly smoked marijuana. There was still smoke in the air and an ad-hoc marijuana pipe on the workbench where Stephens had come from. Officers seized the items and he was taken to jail.

The arrest stems from a May 16 incident on Applegate Way. Officers arrived and found the victim to have fresh blood on her teeth and lips and scratches on her face. The woman identified Stephens and the person who battered her.

Officers put out an attempt to locate Stephens. A warrant check on the man returned that he is an ex-felon for domestic battery and was recently put on probation for violating a restraining order by the victim, according to the arrest report.

Stephens faces the following charges: home invasion and domestic battery, both felonies and misdemeanor possession of drug paraphernalia and violation of pre-trail conditions.

In other arrests:

— A 21-year-old transient, Timothy Todd Jim Jr., was arrested May 23, on felony warrants for robbery with a deadly weapon, burglary with a deadly weapon and conspiracy to commit a crime. The warrants were issued April 11, 2014 out of Carson City Justice Court. Bail: $50,000.

— A 45-year-old Carson City man, David William Bilak, was arrested Friday in the 1500 block of East Long Street, on felony charges of assault with a deadly weapon and being in possession of an illegal, short-barreled shotgun.

According to the arrest report, officers were dispatched to the area Friday night for a report of a man with a shotgun and two handguns who had been threatening people. Officers were in the area earlier in the day regarding a battery that happened with Bilak who had been struck in the face after an argument with another man and lost a tooth. Bilak was intoxicated and uncooperative with officers during the incident, the arrest report states.

Upon arrive officers observed the garage door closed but could hear cussing and yelling inside the garage and later in the residence. Officers spoke to several witnesses who stated the man was angry about being punched earlier in the day and had been drinking.

One witness stated that he went to check on Bilak at his residence because of the commotion coming from the home. The witness stated the man appeared very agitated and was yelling and screaming while holding a sawed-off shotgun, walking in and out of his garage. The witness said he told Bilak to unload the weapon, which he did, and placed it on the couch. When Bilak turned away from the shotgun, the witness took it and two shells and hid it from him, the arrest report states.

Bilak and his mother-in-law went down the alley and told the witness to give him back the shotgun. The witness said he refused until Bilak calmed down. As they were walking back to their apartment Bilak stated he had two handguns at the residence as well. Another witness also stated he had two handguns in the garage. Several other witnesses, who declined to fill out statements from the first incident and this incident, stated Bilak had threatened to shoot them all and that they were "niggers," the arrest report states.

Deputies arrived on scene and formed a perimeter around the residence. Officers could hearing yelling coming from inside. Officers proceeded to call Bilak and all other occupants of the residence outside one at a time. He came outside but remained uncooperative. He was placed in custody at 9:16 p.m.

Bilak's mother-in-law stated she took the two handguns from the garage and hid them in an upstairs closet to keep them from the man. Officers retrieved two handguns from the upstairs closet. The sawed-off shotgun that Bilak had in his possession had a barrel length of 14-1/2 inches, below the legal limit of 18 inches, according to the arrest report. He was taken to jail and a preliminary breath test was given with a result of .183. Bail: $25,000.

— A 57-year-old Carson City man, Vincent Moriarty, was arrested May 24, 9:05 p.m. on a felony drug possession charge and misdemeanor drug paraphernalia. Officers recovered a baggy with meth residue and a "tooter" straw. Officers were called to the location after there were reports of suspicious drug activity. Bail: $3,637.

— A 55-year-old Carson City man was arrested May 24, 4:51 a.m. at Washington and Plaza streets on a gross misdemeanor charge of attempting to use a credit card without the owner's consent and misdemeanor attempt to obtain money under false pretenses.

According to the arrest report, officers were dispatched to a casino in the 500 block of Carson Street in reference to a report of a subject using a stolen credit card.

While responding to the scene, officers advised they had located the suspect. Casino security identified the man as the person who went to the cashier cage and attempted to obtain approximately $200 from an ATM credit card from a person with another person's identification. The victim stated she had lost the ATM credit card approximately two days prior. Bail: $3,137.

— A 50-year-old Carson City man, Britt Andrew Taylor, was arrested Sunday, May 25, 11:46 p.m. in the 1400 block of Rand Avenue on a felony parole and probation charge, and misdemeanor violation of a suspended sentence. The man was on alternative sentencing with a "no alcohol clause." Officers were advised Taylor had been drinking. He was asked if he had been drinking. The man replied he only had one drink. A preliminary breath sample was given in which he blew a .115. Bail: $3,000.

— A 21-year-old Carson City woman was arrested Sunday, May 25, 12:36 a.m. on a gross misdemeanor charge of battery on a police officer and two misdemeanor charges, disorderly conduct and obstructing and resisting. She was arrested in the 300 block of North Carson Street. Bail: $3,154.

Those arrested and facing criminal charges are innocent unless proven guilty in a court of law.
