Carson City deputies make arrests in robbery, stabbing cases
Two Carson City men were arrested and face felony robbery charges. Orion Tova, 42, and Kyle Carpenter, 25, were arrested as a result of a confrontation that was said to be about the victim having stolen money from the suspect's mother who said he was trying to get it back.
According to the arrest report, officers were dispatched Jan. 18 to the 3800 block of Highway 50 East in reference to a robbery in a casino parking lot. The men were detained, while a third subject, identified as the one who said he was the victim in the crime was found across the street watching the arrest. Officers approached the man who identified himself as the one who had been robbed and said Tova and Carpenter were the ones that robbed him, the arrest report states.
The man who said he was the victim explained that he was sitting in his car with the window down when the two men walked up to his car with Carpenter getting into the passenger seat while Tovar stood outside.
He told officers that Carpenter had a weapon, known as a "smiley" which is a rag with a pad lock tied at the end. The man who said he was robbed said Carpenter was swinging it in circles in a threatening manner and told him "you stole $120 from my mom" and demanded money, according to the arrest report.
The man who said he was robbed said Carpenter pulled the keys out of the ignition and threatened to take the car unless his mother's money was given to him. The man who said he was robbed then told police that Tovar put one hand inside his jacket and said "you'd better pay the man or you're going to get messed up," according to the arrest report.
The man who said he is the victim told police he feared Tovar had a gun in his jacket and said Carpenter threatened to hit him with the crude weapon, according to the arrest report. The victim told the men he had $200 in his wallet and so he gave Carpenter six $20 bills. The man who said he was robbed told police that Carpenter gave him his keys back and then walked away. That's when he called 911 and said he had never seen the men before in his life, according to the arrest report.
After the interview, officers spoke with one another and it was determined that Carpenter indeed had six $20 bills and the weapon in his pocket when he was searched.
In another interview, police spoke with Carpenter, who was given his Miranda rights to speak in which he agreed to them and told police his side of the incident which was that the man buys and sells prescription pills. He said he knows the victim through his girlfriend. He also said the man took $120 from his mother.
Carpenter told authorities that he knew the man was going to be at the casino because of a text message he saw from his girlfriend in which there was reference to buying pills. Carpenter said he went instead because he wanted to confront the man regarding the $120 stolen from his mother. Carpenter said he went up to the man's car and was invited inside and was paid money for pills. Carpenter said he confronted the man about his mother's money and said at that point the man told him to get out of the car in which he said he complied, got out of the car and walked away.
Officers asked Carpenter if he used the "smiley" weapon to intimidate the man, in which he replied that he did not remember if he pulled it our or not, adding that he always keeps the smiley in his pocket.
Officer spoke with Tovar who waived his Miranda rights and explained his side of the incident. He said Carpenter called him and asked for help in watching his back while he met with someone, the arrest report states.
Tovar said Carpenter was meeting with some who stole money from his mother and stated that they walked to the casino and met with the man who was sitting in the car. He said Carpenter told the man to give him back the money that he stole from Carpenter's mother. He said Carpenter pulled out the smiley and used it to threaten the man. Tovar said the man gave Carpenter the money and then they walked away and at one point added that Carpenter said he wanted to get out of the area because he thought the man who stole his mother's money would shoot him.
Because of the totality of the circumstances, Carpenter and Tovar were arrested. Carpenter faces a charge of armed robbery, a felony. He was being held on $40,000 bail. Tovar faces a charge of conspiracy in a robbery. His bail was set at $40,000.
In other felony related crimes:
A 27-year-old Carson City man was arrested after allegedly stabbing a neighbor with a Samurai-style sword in the buttocks and side.
Tye Andrew DeForest, was arrested in the 2300 block of North Carson Street on Jan. 18, 5:50 p.m. According to the arrest report, officers were dispatched to the area after a report of a stabbing that happened sometime overnight.
Deputies arrived at the apartment complex and went to the apartment in question. The door was opened by DeForest who was with a woman standing behind him, the arrest report states.
Officers asked DeForest if he had stabbed anyone the night before with a Samurai-style sword. DeForest said he had, that it was his next door neighbor and it was only "once in the butt," the arrest report states. Officers asked the man why he did it and DeForest said he felt threatened by the neighbor and therefore stabbed him in self defense.
Officers asked DeForest if the neighbor had any weapons or battered him in any way, and DeForest said he had not, adding that the neighbor had come over yelling at him for making a loud noise so when he went to open the door he did so with the sword, according to the arrest report.
Officers asked DeForest if he was sure about stabbing the man only once and he said he was sure. The man, who has a diagnosed mental condition, began to become angry with the officers, yelling at them and repeated that it was only once (the jab or stab) and it was actually the victim who walked into the sword.
Not knowing if DeForest was having an episode with his illness, officers spoke with the neighbor who was stabbed. The neighbor answered the door and was limping. He told the officer that his "f**king crazy neighbor" DeForest had stabbed him twice. The officer asked where he was stabbed and the man pulled down his shorts and showed two stab wounds on the right side, one of the wounds was on the buttocks and the other was in the hip area.
Officers asked the stab victim why he had not reported the assault and the man said he was intoxicated and needed to go to sleep before having to go into work. He said he did not know when the stabbing happened but that it was late, the arrest report states.
The victim said he had been trying to "get with his lady" that night and all he could hear was DeForest banging on the walls and slamming the front door. He said he went over to the apartment to ask DeForest to keep the noise down. He said he knocked on the door with DeForest opening it and that the sword — which wasn't in a sheath — was resting on his shoulder, the report states.
The victim told authorities that he has known DeForest for quite some time, that he needs "major help" and that they used to be neighbors when they both lived at a north Carson Street flop house. The victim said DeForest walked back into the room toward the bathroom and so he walked in the door and stood by the bed.
The victim said DeForest lunged at him with the sword lowered and stabbed him twice on the right side and that he was shocked and tried to talk with DeForest but didn't feel safe any longer by being in the room, the report stated. Both stab wounds were deep but had stopped bleeding. The victim declined medical attention but said he would complete a statement and wanted to press charges, the report states.
Officers observed dried blood on the floor by the bed in the apartment. Officers asked DeForest if he was sure the neighbor had come after him in the back of the apartment, and he said he was sure. Officers could not find any blood in the back of the apartment.
DeForest was arrested after a brief struggle and said officers were making a false arrest and that they instead should be cited for trespassing, the arrest report states. Photos were taken of the blood spots and booked into evidence and the victim filled out a short statement.
In other arrests:
A 34-year-old Carson City woman faces two counts gross misdemeanor battery on police officers and five misdemeanor charges including DUI after an accident involving three vehicles. The woman was arrested Jan. 19, 1:41 a.m., in the 200 block of Tacoma Street in Carson City.
According to the arrest report deputes were dispatched at 1:15 a.m. to Tacoma Street in reference to an accident that happened in which the reporting person said there were two vehicles involved caused by a woman who was driving a Volvo.
Officers arrived at the scene and found the Volvo with California plates that appeared to have left the southbound travel lane and crashed into a black car parked on Tacoma Street and then a Toyota truck in the driveway. The accident caused significant damage to all three vehicles, the arrest report states.
Officers spoke with the woman in the Volvo who told them how she came around the corner and then simulated a crash sound with her hand. The woman, who appeared "grossly intoxicated" to officers, said she didn't know why the accident happened and that she had been drinking at a local bar (but only 1 and a half beers) and was on her way home.
The woman submitted to four field sobriety tests in which she failed all tests. She was taken into custody and she advised that she would participate in an evidentiary breath test. During the breath test she refused to breath into the tester, according to the police report. She was given numerous opportunities but refused.
A phlebotomist was called for a blood draw. She became uncooperative, tried to kick the phlebotomist, and instead kicked two deputies in the stomach, leg and abdomen. The deputies did not receive any injuries from the kicks, but the woman, in doing the kicking, was charged with two counts gross misdemeanor battery on a police officer.
The following charges apply to the woman: DUI first offense, driving on a suspended license, no proof of insurance, driving on expired registration, failure to maintain a single lane. Bail: $5,145.
— An 18-year-old Dayton man was arrested at 7:51 a.m. Jan. 18 at South Ruth and Willard Lane and faces a misdemeanor charge of being in violation of a restraining order.
— A 33-year-old Carson City woman was arrested at 1:15 p.m. Jan. 18 at the intersection of Brown and Highway 50 East. She faces misdemeanor charges of failure to appear on a traffic citation and possession of marijuana.
— Those arrested are innocent of crimes they are charged with until proven guilty in a court of law.
