Gibbons to Masto: "Fine, I'll file suit against the health care law myself!"
In an act of defiance against the advice given him by Attorney General Catherine Cortez-Masto, Governor Gibbons appears to be arranging to have private counsel, acting on his behalf as Governor, file suit against enactment of the recently passed National Health Care Reform Act.
Gibbons said "I regret our attorney general is not willing to fight for the rights of Nevadans to be free of illegal federal intervention in their lives." Masto told Gibbons in an official letter of response that she will not file suit against enforcement of the act in that "the authority given to Congress is extensive and appears strong enough to support the act. In my professional judgment, joining the litigation filed by 14 other states, as you have suggested, is not warranted by existing law at this time."
Gibbons said private attorneys have contacted his office willing to represent Nevada without charge.
