A 41-year-old Sacramento man was arrested Saturday for suspicion of misdemeanor obtaining money under fall pretenses.
According to the booking report, deputies were sent to a store in the 3800 block of South Carson Street in reference to a petit larceny in progress. Store employees called dispatch and claimed a man wearing all black clothing was leaving the store with more than $500 of merchandise. The reporting party also said the man was accompanied by a juvenile wearing an orange shirt and hat.
Deputies arrived and made contact with two males matching the description, a man and a juvenile. The man was carrying a store bag with two women’s purses in it. He said he purchased the items legally and provided deputies with a receipt.
The deputy then spoke with the juvenile who said he was in the store to purchase a gift for his mother’s birthday. The juvenile said the suspect approached him outside the business and offered to purchase the gift for his mother with a gift card that he had and could reimburse him with cash.
It appeared as if the man was involved in some sort of fraud scheme, the report states. Deputies spoke with store employees, providing clarification advising the man had come into the store earlier at 12:30 p.m. and loaded a backpack with clothing and merchandise and left the store without paying for the merchandise, the report states.
A store employee stated that it is the store’s policy to not contact law enforcement for shoplifting incidents. The employee claimed the man came back to the store at 1:30 p.m. and tried to return the merchandise he stole. The report states the man was semi-successful and was issued store credit for the items amounting to $494.17. This is when the store decided to report the incident, the report states.
Four employees positively identified the man as the person who stole the merchandise as well as the person who returned the merchandise. Store staff supplied deputies with the receipt from the man when he returned the merchandise.
A store employee also claimed the man had been asking people in the store if they wished to purchase the gift card from him in cash. He then allegedly said he did not have the receipt for the merchandise he was trying to return and said he paid for it in cash, the report states. The suspect was not able to provide the deputy with any proof that he legally purchased merchandise.
It was clear the suspect was trying to get cash for merchandise he stole and later returned and that he tried to sell the store credit gift card to the juvenile and other patrons as part of a scheme with actual cash, according to the report.
The deputy confronted the suspect with this information. The suspect claimed he did not return anything and he bought the two purses with his own money, the report states. This was disproved when the man allowed the deputy to look at his receipts and he had the identical copy of the receipt store staff had provided from the return transaction, proving the man was lying.
A deputy was also able to see the purses the man purchased were bought with the store credit gift card the man had fraudulently received from the transaction. Store staff advised security had video footage that showed the man stealing the merchandise on the first encounter. Based on the evidence and consistency of witness statements, the man was arrested for obtaining money under false pretenses. Bail: $1,137.
