Carson City man jailed after allegedly threatening to kill ex-girlfriend with gun

A Carson City man was jailed Tuesday on suspicion of felony assault with a deadly weapon after he allegedly broke into the home of his ex-girlfriend and threatened to kill himself and her with a semi-automatic handgun.
Jorge Alberto Garcia-Austria, 34, was arrested following the alleged incident that happened Monday in the woman's Koontz Lane home. He is is being held on $23,137 bail.
According to the arrest report, deputy Don Gibson met with the victim Tuesday morning at the sheriff's office along with Capt. Clay Wall. The woman turned over a semi-automatic pistol to the officers and explained that she took it from her ex-boyfriend.
The woman, who lives in Carson City and works at Lake Tahoe, explained she arrived to her home from work and found the man inside and uninvited. The couple had ended their relationship about a month prior and he did not live in the residence, according to the arrest report.
The victim told officers that Garcia-Austria asked her to go into the bedroom with him. She said she agreed so that she and he could talk and that her adult son was in the home. Once in the bedroom the victim advised she noticed a box of bullets sitting on the bed. She said Garcia-Austria was sitting on the bed and she was sitting next to him in a small chair. She said Garcia-Austria told her not to worry about the bullets as he then pulled a gun from under a pillow.
The victim advised she asked Garcia-Austria why he had a gun and he told her that he was going to kill himself, the arrest report states.
Hoping to calm the situation, the woman said she told the man that things would be fine and they could work on their relationship. The victim said she told Garcia-Austria this so he would not harm himself, the arrest report states.
The victim told Gibson that as she spoke with Garcia-Austria, he kept pointing the gun at his temple, in his mouth and on his forehead. The woman stated he kept saying to her that his life was over and he did not want to live anymore, the arrest report states. The victim advised she was extremely frightened and was trying to calm down Garcia-Austria.
The victim told officers the man then turned the gun toward her and told her she did not deserve to live either. She said he then began to slap her across the cheek with the gun. She described this as the gun hitting one cheek, which caused her head to turn and then Garcia-Austria would hit the opposite cheek with the gun, the report states.
She said he then told her he would end her life because she did not deserve to have a happy life. She stated Garcia-Austria then placed the gun on her temples, under her chin and on her forehead, saying he was going to kill her, the arrest report states. The victim advised that after an unknown amount of time pleading with him not to shoot her, and not to shoot himself, that he finally calmed down.
The victim said Garcia-Austria continued to hold the gun in his hand and asked that she lay on the bed with him. She stated while on the bed she began to kiss the man trying to get him to believe their relationship was going to be OK. She advised that Garcia-Austria asked for sex and she agreed in another attempt to make him believe she cared, the arrest report states.
The victim said after intercourse, Garcia-Austria began to fall asleep at which time she tried to get up out of the bed. She stated the man then grabbed ahold of her and would not allow her to get up, grabbing her each time she attempted to get away.
The victim advised her adult son was in his bedroom the entire night and feared for his safety as well. She stated that when she woke up Tuesday morning, she was able to retrieve the gun while he was asleep. Garcia-Austria woke up and became upset and asked for the gun back. The woman told him she did not have the gun.
Following a verbal argument outside the woman's home, the woman drove off on her way to work at Lake Tahoe and phoned a friend, explaining to him about the incident. The friend told her to go to the sheriff's office and file a report.
The woman stated she got to Tahoe and met with a deputy at the Douglas County Sheriff's Office at Lake Tahoe who was able to help her translate her English. The Douglas County deputy advised the woman to go the Carson City Sheriff's Office.
Later, Garcia-Austria arrived at the Carson City Sheriff's Office to file a report about a stolen gun. He did not know that Deputy Gibson had already spoken with the woman, the arrest report states.
Garcia-Austria told Gibson that Monday around 2:30 p.m. he went to a Carson City gun store where he purchased a gun and bullets for $701. He advised that about an hour later he went to the woman's house, whom he said was his girlfriend, to spend the night with her, the arrest report states. He stated when he arrived he knocked on the door and received no answer.
He stated he checked the door and found it to be unlocked so he went inside. He advised he waited in her bedroom until she arrived home at 6:15 p.m. He said he then asked the victim if they could go into her room and talk.
Garcia-Austria told deputy Gibson that he went into the room with the woman but that nothing happened. He did advise he and the victim are having relationship problems, but the night when he was there, things were great and they even had sexual intercourse, the arrest report states. He denied ever pointing the gun at himself or the victim.
The man told Gibson that he has been in America for about five years and was formerly a federal police officer in Mexico. He also indicated this was his first gun he has ever purchased.
Gibson asked if he purchased the gun because of sadness and asked if he intended to harm the victim. He advised he did not and only purchased the gun because he wanted a gun. Gibson asked why he went into the victim's home uninvited and he said because the door was unlocked. Garcia-Austria was asked why he took the gun into the victim's home and he said he did not want to leave it in his car.
Gibson then confronted Garcia-Austria with the allegations made by the victim. The man denied ever having a "problem" with the victim and advised that all he wanted was his gun back.
Based on the victim's allegations, her demeanor, the corroboration of times and calls with the friend and the Douglas County Sheriff's Office, the purchase of a gun the same day, the uninvited entry into the woman's home, Gibson arrested Garcia-Austria on suspicion of felony assault with a deadly weapon and misdemeanor domestic battery.
