On Thursday night, Carson City Sheriff’s Office deputies stopped a vehicle leaving the Carson Mall after watching it make a “very slow turn” onto Stewart, briefly cross over the line, and continue on under the speed limit.
According to the arrest report, the vehicle continued to swerve from the yellow left land to the right white dotted line for several blocks.
Deputies stopped the vehicle just before the intersection of Stewart and Musser.
Deputies spoke to the driver, identified as a 44-year-old Sparks resident, who produced his driver’s license as soon as the deputy approached the window.
he had “visible sweat” and slurred speech according to the reporting deputy, and when the deputy asked for the man’s registration and insurance, he said he “had to call someone.”
He refused to open the glove box or search the car for the registration document, and instead made a phone call.
He told deputies he was aware his registration is expired, and dispatch confirmed it expired in November 2024.
The deputy asked the man when he’d had a last drink of alcohol, and the man said he’d “had one at a con hole game at the Carson City Mall” according to the arrest report.
The man agreed to a field sobriety test, and when he stepped out of the vehicle, the deputy could see a mostly empty plastic shot-sized container of Fireball, according to the arrest report.
The man then stumbled to his right while walking toward the vehicle’s passenger side, and the deputy “had to point in the direction I wanted him to walk.”
While the deputy was reading him the medical portion of the standard field sobriety test sheet, the man said he was from Sparks and was not familiar with Carson City, “but advised he knew he was in Carson City.”
He said he wanted to blow into a preliminary breath test (PBT) instead, and “was starting to act noticeably panicky,” according to the report.
The deputy said he calmed the man down and informed him that the questions were medical questions to gauge where he stood cognitively, and the man agreed to continue with the test.
He said he’d had “one or two beers at the mall” about forty minutes prior, and started drinking around 7 or 8 p.m. (the arrest report states the deputy first saw the vehicle around 9:45 p.m.) and said he does not used controlled substances.
During the tests, the deputy stated the man showed multiple clues of impairment including being unable to walk heel-to-toe, raised his arms for the entire walk and turn test, and could not follow the deputy’s finger with his eyes.
Finally, the man stated he no longer wanted to participate in the test, and that “he could not do it.”
The deputy took him into custody, and the man provided a PBT with a result of 0.207 BAC.
He gave deputies permission to park the vehicle in a parking space, which they did, and he was taken to the jail without incident.
