A 42-year-old Fallon man was arrested for resisting arrest and a pre-trial violation Monday afternoon after deputies were dispatched on report of a man sleeping on a bench at Mills Park.

According to the arrest report, just after 2:30 p.m., deputies arrived at the park and located a man sleeping on a bench near a VA memorial on the southeast side of the park.

They woke the man and spoke with him, and stated he was “clearly intoxicated” with slurred speech and red watery eyes.

Deputies say he became “verbally aggressive” and dispatch advised he is currently under the supervision of the Department of Alternative Sentencing with a condition not to consume or possess alcohol. A PBT resulted in a BAC of .208.

Dispatch advised DAS wanted to place a hold on him for violating his conditions, and deputies told the man he was being placed under arrest, and the man “immediately tensed up to the point where I could feel his muscles on his arm tightening,” according to the reporting deputy.

However, they said, the man had a broken arm with a cast on his right arm. A deputy placed handcuffs on his left arm and secured it to his belt loop while the reporting deputy controlled the arm with the cast.

During this time, the deputy said, the man was pulling and pushing in an attempt to get away. The reporting deputy said he tripped him to take him to the ground to gain compliance, and while on the ground they told the man several times to stop resisting.

The deputy said they asked the man several times to stand up and walk to the patrol vehicle, “at which point he would walk approximately five to ten feet, then go dead weight and fall to the ground.” This occurred three times, the report stated.

After the third time, the reporting deputy stated the man went dead weight and pulled away from them towards the other deputy, and was pepper sprayed.

He was taken to the hospital for the pepper spray, broken arm, and alcohol level.

He was later released to jail staff without further incident and booked for DAS violation and resisting arrest.

Carson City man with mental health issues arrested for drinking, attempting to light grass on fire

— A 33-year-old Carson City man was arrested for violating DAS conditions Monday night after his girlfriend called 911 stating he was having a metal episode and was “attempting to light grass on fire.”

When deputies arrived, they spoke with the girlfriend who said the man was intoxicated and on parole, and that he’d become angry and tried to light a small patch of grass on fire in the backyard.

Deputies located the man “hiding” at the rear end of the house, and stated that due to his behavior he was placed in handcuffs.

Dispatch advised the man was on DAS supervision with conditions of no alcohol, and the man had a strong odor of alcohol coming from his person.

The girlfriend told deputies she believes he has an undiagnosed mental health condition, and he “sometimes will get angry when he drinks.”

She said while drunk, the man had playfully hit her on the back, but clarified it wasn’t with the intent to harm her. She said she then flicked water at him, also in a playful manner.

However, she said he “lost his temper”  and started calling her names and slamming things in the house. He then took a lighter to the backyard and began trying to light the grass on fire.

DAS advised they wanted him detained for violating his conditions, and he was taken to the jail where he provided a PBT of .215 BAC.
