DUI, driving without headlights
— A 31-year-old Carson City man was arrested in the area of 4100 S. Carson St. for DUI first and driving without headlights on.
According to the arrest report, the man was arrested just after midnight after deputies were patrolling the area and noticed a vehicle driving with no tail lights. However, when the deputy turned around the follow the vehicle, the vehicle’s tail lights came on, the deputy said.
The deputy observed the vehicle cross the fog line on the right side of the roadway, then correct, then cross again, then correct again.
The vehicle then signaled to turn right and braked, and started to pull into the entrance of the Wendy’s, but then continued straight and ultimately pulled into the parking lot of a gas station.
The deputy then activated their overhead lights and conducted a traffic stop.
While they were approaching the vehicle, the driver got out and began approaching the store entrance, “while looking straight ahead as though he was attempting to ignore my presence,” the deputy noted.
However, when the deputy called out to him and told him to come to the patrol vehicle, he did so.
The deputy spoke to the driver and observed a strong odor of an alcoholic beverage emanating from his person, and had red watery eyes. However, the driver denied drinking, and agreed to a field sobriety test.
He then said that he had been drinking earlier in the day, and that he had used a marijuana vape pen. The deputy said they checked his mouth and nasal cavity and “did not observe any blatant indicia of drug use.”
During the tests, the deputy observed three out of six clues of impairment for one test, six out of eight clues for another, and one out of four clues for the one-legged stand test.
He then advised the deputy should take him to jail. He consented to a PBT test which provided a result of .392 BAC.
He was taken into custody without issue.
