What can you do with a gun that is both illegal and would not already be punished severely if you commit it? Nothing, of course. Even if you do use your gun for a perfectly legal purpose such as self-defense, you are in for a world of hurt as the authorities descend upon you to verify every little detail of what you claim had happened.
So what does SB221 accomplish that already existing law does not? Absolutely NOTHING.
Nothing, except the sub rosa, nefarious and illegal goal of universal gun registration. Not universal background checks, but REGISTRATION.
Now if your true intent is to send America down the path to universal disarmament, tyranny and mass executions which is the hell that every other country descended into after universal gun registration, and if you want to achieve this evil goal surreptitiously by hoodwinking the gullible populace that you are doing something for their own good, then this is precisely how you do it.
Think it through. Do you REALLY expect that the government would run a computer system without redundancy and regular backups? In this age of spying on journalists and political opponents, the politically motivated selective enforcement of tax laws, and the IRS, the SSA, Medicare, HHS, DHS and others building and keeping permanent files on everybody, do you REALLY expect that the government would NOT keep a record of all who underwent a background check? They couldn't help but keep records even if they tried not to.
If SB221 passes, a father could not gift his guns to his sons and daughters, and aunt or uncle to their nieces and nephews, etc. A friend could not let another friend shoot his guns when hunting, or even on the rifle range. A husband could not give his gun to his wife to protect herself when he is traveling on business. All these people would end up in jail for acting according to common sense.
The only way anyone would know if this law was violated is if someone had committed another crime which is already punishable under another law; SB221 accomplishes absolutely NOTHING new, legitimate or useful. It would most emphatically NOT fulfill its stated purpose of keeping guns out of the hands of criminals and the insane, because those are precisely the people who would NOT bother with this law, especially as they are also NOT deterred by all the other laws against planning and committing the crime for which they need a gun.
Do we even have enough cops to enforce such an ill-conceived law? How would you do it, go door to door, ransack every house, set up roadblocks and search every car? Stake out every rifle range, patrol every hunting ground, spy on every birthday party?
Has everybody in their feverish frenzy to "do something" got such a brain freeze that they can't think things through to their logical end?
Check your copy of the US Constitution and the founding documents, the Federalist and Anti-federalist Papers. The only thing that the government can lawfully expect is that everybody shows up armed when the militia is called out. They cannot pre-verify if everybody has a gun, and at best they can find one to give you if you answer the call and show up without one. That is it -- and for a very, very good reason, because it is the armed citizen who is the last defense against tyranny.
The least that the legislature can do is let SB221 die in committee. And if it survives there, then kill it in the Assembly. And if it passes there, then kill it with the Governor's veto.
Thank you.
