The Lyon County Sheriff’s Office will cooperate with our partnering Federal Agencies in immigration enforcement matters and events.
This Personnel order and directive will provide additional direction to the current Lyon County Sheriff’s Office policy:
Lyon County Policy 502.3.1 Immigration Detainers:
No individual should be held based solely on a federal immigration detainer under 8 CFR 287.7 unless the individual has been charged with a federal crime or the detainer is accompanied by a warrant, affidavit of probable cause, or removal order. Notification to the federal authority issuing the detainer should be made before release.
Additional directive:
If an arrestee is brought into the detention facility of the Lyon County Sheriff’s Office and found to be an illegal alien, notification will be sent to the proper federal agency. If a federal agency confirms that finding and places an immigration hold on the arrestee, the Lyon County Jail will hold that arrestee, consistent with the requirements of Nevada and federal law until they are turned over to federal authorities. The Lyon County Detention facility will not hold an illegal alien without a lawful federal hold in place.
Patrol Deputies will not make arrests based on immigration status, and patrol deputies should not attempt to determine the immigration status of an individual; the booking process in the Lyon County detention facility will make any determination regarding an arrestee’s immigration status.
Federal Guidance:
The Supremacy Clause and other authorities permit state and local actors to comply with the Executive Branch’s immigration enforcement initiatives. Federal law prohibits state and local actors from resisting, obstructing, and otherwise failing to comply with lawful immigration-related commands and requests.
Finally, laws and actions that threaten to impede Executive Branch immigration initiatives, including by prohibiting disclosures of information to federal authorities engaged in immigration-enforcement activities, threaten public safety and national security.
