Attorney General Aaron Ford,

It has come to my attention that Nevada Child Support Services is operating in violation of multiple federal and state laws, including but not limited to:

•45 CFR § 303.7(c)(4): Federal law requires states to transfer cases for inter-state enforcement within 20 calendar days of determining the need, yet Nevada routinely fails to meet this timeline.

•45 CFR § 303.8: Federal law mandates that child support cases undergo a review every three years, yet Nevada has neglected this requirement, leaving families without adequate legal recourse.

•Nevada Public Records Act (NRS 239): Records requests submitted to Nevada Child Support Services remain unanswered far beyond the legally mandated five-day window, with some of my open requests dating back to October 2023.

As Nevada’s chief legal officer, you are responsible for ensuring that state agencies comply with the law. I am disappointed with the dismissive responses I have received from your staff and the lack of action to address these systemic violations.

Your duties under NRS 130.308 clearly state:

“If the Attorney General determines that a support-enforcement agency is neglecting or refusing to provide services to a natural person, the Attorney General may order the agency to perform its duties under this chapter or may provide those services directly to the person.”

Attorney General Ford, Nevada families rely on you to ensure fairness, accountability, and justice. I urge you to fulfill your statutory obligations by:

1.Conducting a full audit of Nevada Child Support Services to identify and address violations of federal and state law.

2.Ensuring that unanswered public records requests are fulfilled immediately and transparently.

3.Taking direct action to hold Nevada Child Support Services accountable for its systemic failures to serve families effectively and equitably.

This is not a minor bureaucratic oversight. These issues affect families undermining the public’s trust in the system meant to protect them. I respectfully request that your office take immediate action to rectify these violations and restore integrity to Nevada’s child support enforcement system.

Respectfully,

Theresa Catalani
